MashrakhBazzar Terms of Use

Welcome to MashrakhBazzar (“MashrakhBazzar”, “we”, “our”, or “us”).

These Terms and Conditions (“Terms”) govern your access to and use of the MashrakhBazzar website, mobile application, and related delivery services (collectively, the “Platform”).

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Platform.

1. Eligibility & Account Registration

  1. To use MashrakhBazzar, you must be legally capable of entering into a binding contract under applicable Indian laws.
  2. Persons who are not competent to contract under the Indian Contract Act, 1872, including minors, may use the Platform only under the guidance and consent of a parent or legal guardian who agrees to be bound by these Terms.
  3. Data Collection Policy: We do not collect profile photos or age from users during account creation. Authentication is completed securely via your registered mobile phone number using one-time password (OTP) verification.
  4. You are responsible for maintaining the confidentiality of your mobile device, login sessions, and OTP codes. You agree to notify us immediately of any unauthorized access to your account.

2. Platform Services & Scope

MashrakhBazzar provides a local digital quick-commerce platform that allows customers in and around Mashrakh, Bihar to:

  • Browse grocery, daily essentials, household products, and pharmacy items
  • Place orders for on-demand doorstep delivery
  • Make payments using Cash on Delivery (COD) or Unified Payments Interface (UPI)
  • Upload doctor prescriptions for verified pharmacy orders
  • Track delivery progress and manage saved addresses
  • Contact customer support via phone or WhatsApp

Service availability depends on store inventory, local delivery capacity, and operating hours. We reserve the right to modify or discontinue any feature without prior notice.

3. Serviceable Areas & Delivery Limitations

  1. MashrakhBazzar operates hyperlocally in Mashrakh, Saran (Bihar) and designated surrounding zones.
  2. Delivery availability depends on distance, route accessibility, road conditions, and severe weather.
  3. We reserve the right to cancel an order after placement if the delivery address is outside our active delivery radius or inaccessible to delivery partners. In the case of prepaid orders cancelled by us, a full refund will be processed promptly.

4. Product Listings, Availability & Fresh Produce

  1. We make every reasonable effort to display accurate product details, descriptions, images, and prices. Product images are for illustrative purposes; actual packaging, branding, or appearance may vary.
  2. Fresh Produce & Weight Variance: For items sold by weight (such as fresh vegetables, fruits, and loose items), actual delivered weight may vary slightly due to natural product variance and packing. A reasonable variance shall not be considered a defect.
  3. Products are subject to real-time stock availability. Placing an item in your shopping cart does not reserve inventory until the order is successfully confirmed.

5. Pricing, Delivery Charges & Platform Fees

  1. All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.
  2. Free Delivery: Orders that meet or exceed our minimum free delivery order threshold (currently ₹599) qualify for free delivery.
  3. Delivery & Handling Fees: For orders below the free delivery threshold, a standard delivery fee (e.g. ₹39) and any applicable handling charge will be clearly displayed in the order summary before checkout.
  4. The final payable amount displayed at checkout is the definitive total for the order.

6. Orders & Acceptance

  1. Submitting an order constitutes an offer to purchase the selected items.
  2. An order is confirmed once accepted and assigned for picking and dispatch.
  3. MashrakhBazzar reserves the right to reject, cancel, or limit the quantity of any order due to:
    •Out-of-stock items or quality check rejections
    •Incomplete or unverified delivery address
    •Suspected fraud or multiple fake orders
    •Severe weather or transport disruptions

If an item becomes unavailable after order placement, we may partially fulfill the order, charging you only for the delivered items and refunding any prepaid amount for unavailable items.

7. Payments & Security

We offer the following payment methods:

  1. Cash on Delivery (COD): Available for eligible items and locations. Payment must be handed over in cash or paid via UPI to our delivery partner upon arrival.
  2. UPI Payments: Direct transfer via authorized UPI apps (such as Google Pay, PhonePe, Paytm, BHIM) or dynamic QR code scanning at checkout.
  3. Security Guarantee: MashrakhBazzar never collects, processes, or stores your UPI PIN, banking passwords, or card credentials.
  4. Failure to complete payment upon delivery for COD orders may result in suspension of your account and restriction of future COD privileges.

8. Pharmacy & Prescription Orders

  1. Prescription Required: Products categorized as prescription drugs (including Schedule H medicines) strictly require a valid, legible prescription issued by a registered medical practitioner (doctor).
  2. Verification by Licensed Pharmacist: Uploaded prescriptions are verified by licensed partner pharmacists before the order is processed and dispatched.
  3. Right to Reject: MashrakhBazzar reserves the absolute right to cancel pharmacy orders if:
    •The prescription is missing, expired, illegible, or altered.
    •The ordered medication is not clearly prescribed.
    •The prescription does not meet statutory requirements under the Drugs and Cosmetics Act, 1940 and rules thereunder.
  4. Medicines once dispensed and accepted upon delivery cannot be returned unless delivered in a damaged, defective, or expired condition.

9. Prepared Food, Restaurant & Vendor Orders (Intermediary Role)

  1. Intermediary & Delivery Link: For prepared meals, restaurant items, cooked food, and baked goods, MashrakhBazzar operates strictly as a digital marketplace intermediary and delivery link connecting customers with independent third-party merchants, restaurants, and food vendors.
  2. Vendor Liability for Food Quality & Safety:
    •All aspects of food preparation, hygiene, taste, freshness, ingredients, packaging, and compliance with statutory food safety regulations (including FSSAI standards) are the exclusive responsibility of the respective food vendor.
    •MashrakhBazzar does not cook, manufacture, inspect the interior of, or alter food items. Our delivery partners only transport the sealed package handed over by the vendor.
  3. Allergens & Dietary Information:
    •Dietary indicators (such as vegetarian or non-vegetarian markings) and ingredient lists are displayed based on information provided by the vendor.
    •Customers with specific food allergies, sensitivities, or dietary restrictions must exercise caution. MashrakhBazzar disclaims all liability for allergic reactions or health issues arising from vendor food preparation.
  4. Non-Returnable Prepared Items: Cooked meals and fresh food items cannot be returned or cancelled once prepared or dispatched, except where the item delivered is incorrect or the package was physically damaged/spilled during transit.

10. App Permissions & Digital Features

  1. Location: Used with your permission to determine service availability and accurately position your delivery location on Google Maps. Location sharing is optional; addresses can be entered manually.
  2. Microphone (Voice Search): Used solely to transcribe voice search queries into text. Audio is processed on-the-fly and is never stored, recorded, or shared.
  3. No Tracing / Analytics: MashrakhBazzar does not employ cross-app tracing, crash telemetry, or third-party advertising SDKs.
  4. Account & Data Deletion: Users have the right to request deletion of their account and associated personal data at any time:
    •Public Web Form (No App Reinstallation Required): Accessible from any web browser on desktop or mobile at https://mashrakhbazzar.com/delete-account without having to reinstall or open the app.
    •In-App: Directly from your mobile app under Profile > Request Account Deletion.
    •Support Channels: By contacting Customer Support via WhatsApp at +91 74883 25385 or email at mashrakhbazzar@gmail.com. Upon verification, personal profile information and saved addresses will be permanently deleted, retaining only mandatory financial invoice records required by applicable Indian tax and statutory laws.

11. Order Cancellation

  1. Cancellation Window (Before Packing): You may cancel your order at any time before it has been packed by our store team. Cancellations can be requested directly from your order details screen or by contacting Customer Support.
  2. Non-Cancellable Once Packed or Dispatched: Once an order is packed or out for delivery, it cannot be cancelled, as products have already been picked, weighed, packed, and assigned to delivery partners.
  3. Platform Cancellation: If an order is cancelled by MashrakhBazzar for any reason (such as stock unavailability or unserviceable address), any prepaid amount will be refunded in full.

12. Returns, Replacements & Refunds

  1. Eligible Return Scenarios:
    •Damaged, spoiled, or defective products upon delivery
    •Incorrect item delivered
    •Missing items billed in the invoice
    •Expired items past the ‘Best Before’ or expiry date
  2. Reporting Window:
    •Perishable Goods (Milk, Dairy, Fresh Vegetables & Fruits, Bakery): Must be reported within 2 hours of delivery.
    •Packaged Groceries & Essentials: Must be reported within 24 hours of delivery.
  3. Non-Returnable Items:
    •Items with opened seals or signs of consumption
    •Perishable items reported beyond the 2-hour window
    •Products damaged due to customer mishandling after delivery
  4. Refund Processing & Timelines:
    •UPI / Online Payments: Approved refunds are credited back to the original source bank account or UPI ID within 5 to 7 business days (subject to bank processing times).
    •Cash on Delivery (COD): Approved refunds for COD orders are transferred directly via UPI or IMPS within 5 to 7 business days upon customer support verification.

13. User Conduct & Prohibited Activities

You agree not to:

  • Place fake, speculative, or fraudulent orders
  • Refuse acceptance of Cash on Delivery orders without valid cause
  • Provide misleading, fake, or inaccurate contact or address details
  • Misuse promotions, discounts, or referral programs
  • Harass, abuse, or mistreat delivery partners or customer support staff
  • Attempt to breach, probe, reverse-engineer, or disrupt the Platform’s digital security

Violations may result in immediate suspension or permanent termination of your account and appropriate legal remedies.

By creating an account, you consent to receive transactional communications regarding your orders, OTP verifications, and delivery coordination via SMS, WhatsApp, email, or phone calls.

15. Limitation of Liability

To the maximum extent permitted by applicable law:

  1. MashrakhBazzar shall not be liable for indirect, incidental, punitive, or consequential damages arising from the use of or inability to use the Platform.
  2. MashrakhBazzar is not liable for delivery delays caused by events outside reasonable control (Force Majeure), including floods, heavy rain, road closures, government restrictions, or network disruptions.
  3. The Platform is provided on an “as is” and “as available” basis.

16. Intellectual Property

All logos, trademarks, interface designs, text, graphics, and software associated with MashrakhBazzar are the exclusive intellectual property of MashrakhBazzar or its licensors. Unauthorized reproduction or exploitation is strictly prohibited.

17. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India.

Any disputes, claims, or controversies arising out of or in connection with these Terms or the Platform shall be subject to the exclusive jurisdiction of the competent courts in Bihar, India.

18. Modifications to Terms

We reserve the right to amend or update these Terms at any time to reflect legal, regulatory, or platform changes. The updated version will be published on the Platform with a revised “Last Updated” date. Your continued use of MashrakhBazzar after any changes constitutes your binding acceptance of the updated Terms.
